About these terms
These terms and conditions ("Terms") are an agreement between you and Sanjay Singh Kushwaha, an AMFI-registered Mutual Fund Distributor holding ARN-364557, who runs SIP to Retire, formerly SIPDhara ("SIP to Retire", "we", "us", "our").
They apply to the SIP to Retire website and any sub-domain, any future domain or brand under which we offer the same services, our mobile apps, our WhatsApp, SMS and email channels, and any call or meeting with us (together, the "Service"). Our Privacy Policy, Cookie Policy, Disclosures and Commission disclosure form part of these Terms.
By using the Service, sending us a question or request, or signing in, you agree to these Terms. If you do not agree, please do not use the Service. You must be at least 18 years old and able to enter into a contract under Indian law; investments for a minor are made through a parent or guardian (see section 8). This is an electronic record under the Information Technology Act, 2000 and needs no physical or digital signature.
Our role as a distributor
- We are a mutual fund distributor, registered with the Association of Mutual Funds in India (AMFI) under ARN-364557. We are not registered with SEBI as an investment adviser, research analyst or portfolio manager, and we do not charge a fee for advice.
- Any explanation, comparison or suggestion we give is incidental to distribution and is based on what you tell us. The decision to invest, and the choice of scheme, amount and timing, is always yours.
- Investments made through us are in the Regular plan of a scheme, on which the asset management company (AMC) pays us commission. Every scheme also has a Direct plan, with a lower expense ratio and no distributor commission, which you can buy directly from the AMC or other platforms. See the Commission disclosure.
- We never hold your money or units. Payments go from your bank account directly to the AMC or to the clearing account of the transaction platform, and units are allotted in your name by the AMC. Never pay cash, and never pay into anyone's personal account.
- We do not promise or guarantee any return, and we do not offer rebates, gifts or cash-backs to induce you to invest.
Mutual fund investments are subject to market risks. Read all scheme-related documents carefully before investing.
Research, data and calculators
- For information only. Fund pages, rankings, comparisons, performance tools, screeners, the Portfolio X-Ray and calculators are general information and education. They do not consider your personal situation and are not a recommendation to buy, sell or hold any scheme.
- Calculators are illustrative. Results depend on the assumptions shown (return, inflation, step-up, time). Assumed returns are kept within the ranges allowed by AMFI guidance. Real returns vary and can be negative.
- Past performance may or may not be sustained in future and is not an indication of future returns. Tables sorted "top by" a metric are sorted by that metric over the period shown; they are not ratings.
- Data sources. NAVs and scheme details come from AMFI and other public or licensed sources, which may be delayed, incomplete or wrong. Each page shows its source and "as of" date. We may correct, change or remove data at any time. Before investing, read the Scheme Information Document (SID), Key Information Memorandum (KIM) and Statement of Additional Information (SAI) on the AMC's website.
- Tax. Any tax figures are simplified estimates under current Indian law. Consult a tax professional for your situation.
- News. Headlines come from official sources (for example SEBI, RBI, AMFI, NSE, BSE and PIB) and link to the original. We do not write, edit or endorse them; the source is responsible for its content.
- Currency display. Amounts shown in a currency other than the Indian rupee are converted with public exchange rates for convenience only. Mutual fund investments in India are made and valued in rupees.
Accounts and sign-in
You can use most of the Service without an account. An optional account lets you keep a watchlist, saved calculations, alerts and portfolio snapshots. Sign-in is provided by Microsoft Entra External ID, with a one-time code sent to your email or with your Google account; we may add other sign-in methods. We never see or store a password.
- Keep access to your email and Google account secure. You are responsible for activity in your account.
- Use only your own account, and give accurate details. Tell us at once if you suspect misuse.
- You can delete your account at any time from your account page or by writing to us.
Questions, call-backs and WhatsApp
When you send a question, message, call-back or "invest" request, you ask us to contact you about it by phone, email or WhatsApp on the details you gave, including outside the hours of the day you wrote and even if your number is on the National Do Not Call registry, because the contact is at your request. Our replies are general information under section 2, not personalised investment advice.
The WhatsApp button opens WhatsApp, a service of Meta Platforms, with a prepared message. WhatsApp's own terms and privacy policy apply to your use of it, and Meta is responsible for its own processing.
We will never ask for your OTP, UPI PIN, card number, CVV, net-banking password or the login of any investment platform. If anyone claiming to be us asks for these, do not share them and tell us at contact@siptoretire.com.
Investing through us
When you invest through us, transactions are carried out on the systems of AMCs and their registrars (such as CAMS and KFin Technologies), MF Utilities (MFU), BSE StAR MF, NSE NMF II or other platforms permitted for mutual fund distributors ("Transaction Platforms"). The terms of the Transaction Platform and the scheme documents apply to each transaction in addition to these Terms.
- KYC. You must complete KYC with a SEBI-registered KYC Registration Agency (KRA) and, where required, the Central KYC Registry, as required under the Prevention of Money-laundering Act, 2002 (PMLA) and SEBI rules. KYC is done on those platforms; we can help you through it.
- Accurate information. You are responsible for correct details, including bank account, nominee, tax residency and FATCA/CRS self-certification, and for keeping them up to date.
- Payments and mandates. Payments, SIP mandates (UPI AutoPay, e-NACH/NACH) and redemptions are processed by banks, NPCI and the Transaction Platform. Mandate limits and debits are between you, your bank and the platform.
- Orders. Orders are subject to acceptance by the AMC. Cut-off times, NAV applicability, exit loads, stamp duty and taxes follow the scheme documents and SEBI rules. We are not responsible for delays or rejections by a Transaction Platform, bank or AMC, or for outages of their systems.
- We may decline to act on an instruction, or stop servicing an investor, where KYC is incomplete, information appears false, the law requires it, or the request is not suitable for us to handle.
Documents you share
To help with KYC or a transaction, we may ask for documents such as your PAN card, bank proof (cancelled cheque or statement), address proof or photograph, through a secure upload or another channel we name.
- Aadhaar: masked copies only. Share Aadhaar only with the first eight digits hidden (only the last four visible). We do not accept full Aadhaar numbers; if one reaches us, we will mask or delete it.
- Share only your own documents, or documents you are authorised to share (for example as a guardian).
- How we protect, use, keep and delete documents is set out in the Privacy Policy.
NRIs, minors and other investors
- Non-resident Indians and OCIs may invest subject to the Foreign Exchange Management Act, 1999 (FEMA) and each AMC's rules; some AMCs do not accept investors resident in the USA or Canada. You are responsible for complying with the tax and other laws of your country of residence, and for your FATCA/CRS declarations.
- Minors invest only through a parent or court-appointed guardian, who acts for the minor and accepts these Terms on the minor's behalf. When the minor turns 18, the account must be updated as the AMC requires.
- Joint holders, HUFs, companies, trusts and other entities act through authorised persons, who confirm that they are authorised.
Alerts, newsletters and messages
We may send you messages by email, SMS, WhatsApp (including the WhatsApp Business API), push notification or phone:
- Service messages: replies to your requests, sign-in codes, alerts you set up (for example NAV moves, NFOs or SIP reminders), transaction and KYC updates, and important notices about the Service or these Terms.
- Newsletters and promotional messages: only where you have asked for them or the law otherwise allows. Every newsletter carries an unsubscribe link, and you can reply STOP on SMS or WhatsApp, or write to us.
We follow the Telecom Commercial Communications Customer Preference Regulations, 2018 for SMS and calls, and WhatsApp's business policies. Unsubscribing from marketing does not stop service messages you need.
AI-assisted features
We may offer features that use artificial intelligence, such as summaries of documents and news, or a chat assistant that answers questions about funds and the Service. AI output can be incomplete or wrong; check it against the source and the scheme documents. AI features give general information, not investment advice, and no decision that affects your investments or your account is made by AI alone; a person is responsible for it. Do not enter passwords, OTPs or identity numbers in an AI feature.
Partners, referrals and testimonials
- We may work with employees, sub-distributors or associates who hold their own valid ARN or EUIN. Whoever services you will be identified to you, and remains bound by the AMFI Code of Conduct.
- Any referral programme will follow SEBI and AMFI rules. We do not share commission with investors or pay incentives that the rules do not permit.
- We publish investor testimonials or reviews only if, and in the form, SEBI's advertising code and AMFI's guidelines permit, only with the investor's written permission, and never as a promise of returns.
- We may use paid or licensed data providers. Their data is subject to their terms, and they are not responsible for our use of it.
Fees and commission
The website, research tools and calculators are free. We are paid commission by AMCs on Regular plans, as disclosed on the Commission disclosure page, and you can ask us at any time for the commission we earn on any scheme you hold or consider. If a transaction charge under SEBI rules or any other charge ever applies, we will tell you before you invest. We will not charge you for advice.
Acceptable use
You agree not to:
- give false information, impersonate anyone, or use someone else's account, documents or payment details;
- scrape, copy or download content or data in bulk, or use bots against the Service, other than normal search engine indexing;
- probe, attack, overload or bypass the security of the Service, including the human check (Cloudflare Turnstile) or rate limits;
- upload malware, or content that is unlawful, defamatory, obscene, hateful, or infringes anyone's rights;
- use the Service to spam, to send unsolicited commercial messages, or to mislead other investors; or
- resell, frame or present the Service or its data as your own.
Intellectual property
The SIP to Retire name and logo, the design, text, calculators, software and compilations of data on the Service belong to us or our licensors. Third-party data, logos and names belong to their owners. You may use the Service for your personal, non-commercial purposes and share links to it. Any other use needs our written permission. If you send us feedback or suggestions, we may use them without obligation to you.
Third-party services and links
The Service relies on and links to services run by others, including Cloudflare, Microsoft, Google, Meta (WhatsApp), AMCs, registrars, KRAs, Transaction Platforms, regulators and news sources. We are not responsible for their content, availability, security or practices, and their own terms apply when you use them.
Disclaimers
We take care to keep the Service accurate, secure and available, but it is provided "as is" and "as available". To the extent the law allows, we do not warrant that it will be uninterrupted, error-free, or that data is complete, current or accurate. Nothing in these Terms excludes any right you have under the Consumer Protection Act, 2019 or other law that cannot be excluded.
Limitation of liability
- We are not liable for investment losses or market movements, for decisions you make based on the Service, or for acts and omissions of AMCs, registrars, KRAs, Transaction Platforms, banks, or other third parties.
- We are not liable for indirect, incidental, special or consequential loss, or loss of profit, data or opportunity.
- Our total liability for any claim relating to the Service is limited to the greater of ₹5,000 and the commission we received for your investments in the 12 months before the event giving rise to the claim.
- These limits do not apply to liability that cannot be limited by law, including for fraud, wilful misconduct, or our obligations as a mutual fund distributor under SEBI and AMFI rules.
Indemnity
You agree to compensate us for losses, claims and reasonable costs (including legal fees) arising from your breach of these Terms, false information or documents you provide, your misuse of the Service, or your violation of any law or third-party right.
Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or close an account, or block access, if you breach these Terms, if required by law or a regulator, to protect investors or the Service, or if we stop offering the Service. Where reasonable, we will tell you first. Closing an account on SIP to Retire does not redeem or transfer your investments, which remain in your folios with the AMCs. Sections that by their nature should continue (including liability, indemnity, intellectual property and governing law) survive termination.
Force majeure
We are not responsible for delay or failure caused by events beyond our reasonable control, such as natural disasters, epidemics, war, riots, government action, market closures, power or telecom failures, cyber-attacks, or outages of hosting, identity, email, messaging or Transaction Platform providers.
Changes to the Service and these terms
- We may add, change or withdraw features of the Service at any time.
- We may update these Terms, for example for new features, new laws or regulator instructions. The version and date appear at the top. For material changes we will give at least 15 days' notice on the Service and, if you have an account, by email, unless a law or regulator requires a change sooner. Continuing to use the Service after a change takes effect means you accept it.
- If we change our brand name or domain, or transfer the business (for example to a company formed by the distributor, or as part of a merger or sale), these Terms continue to apply between you and the new operator, who will be identified on the Service.
Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to the grievance and regulatory routes in section 23 and to any right you have to approach a consumer commission, the courts at [city to be confirmed], India have exclusive jurisdiction.
Grievances and escalation
If something has gone wrong, please tell us first. We will acknowledge your complaint within 2 working days and aim to resolve it within 15 days, and in any case within 30 days.
